Important Notice for European Users

Chappie is currently not available to individuals located in the European Union or European Economic Area (EEA) while we complete our GDPR compliance programme. Please do not download or use the Services if you are based in those regions. These Terms primarily apply to users in the United Kingdom and other non-EU/EEA regions, and to legacy EU users who already had accounts before delisting.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Chappie mobile applications, web experiences, APIs, and related services (collectively, the "Services") provided by Bahut Limited ("Bahut", "we", "us"). By downloading, installing, or using the Services you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 13 years old to use Chappie. If you are between 13 and the age of majority in your jurisdiction, you may only use the Services under the supervision of a parent or legal guardian who agrees to these Terms. By creating an account you represent that you meet these requirements and have the authority to agree to these Terms on behalf of yourself or the entity you represent.

3. Your Account

You must create an account to access most features. You agree to provide accurate information, keep it updated, and maintain the security of your credentials. You are responsible for all activities that occur under your account. Notify us immediately at support@bahut.io if you suspect unauthorised use.

We reserve the right to suspend or terminate accounts that are inactive, non-compliant, or that pose security or legal risks.

4. Subscriptions, Trials, and Billing

Paid features may be offered through subscriptions or one-time purchases processed by Apple App Store, Google Play, or other approved marketplaces. Prices, billing cycles, and renewal terms are disclosed at the point of purchase. Taxes may apply.

• Subscriptions renew automatically until cancelled through the platform where you purchased them.
• Free trials convert to paid subscriptions unless you cancel before the trial ends.
• Payments are final except where refunds are required by law or by the marketplace's policies.
• We may change pricing or features, but will notify you before the change affects an existing subscription.

5. Acceptable Use

You agree to use the Services for lawful, personal learning purposes. You will not:

• Upload unlawful, defamatory, or infringing content, or impersonate others.
• Interfere with or disrupt the Services, attempt to access unauthorised systems, or circumvent security features.
• Use automated tools to scrape, collect, or harvest data without our written permission.
• Reverse engineer or reuse our content, prompts, or AI outputs to build a competing service.
• Harass other learners, tutors, or team members.

We may remove content or suspend accounts that violate these rules.

6. Voice, Audio, and Diagnostics

Chappie’s AI tutor requires microphone access, speech-to-text services, AI scoring, and telemetry (device identifiers, install attribution, crash logs) to function. By using speaking lessons you consent to this processing. If you do not wish to consent, please refrain from using the Services and request deletion via the Privacy Policy instructions.

These data flows begin automatically whenever you open the app. Declining Apple’s App Tracking Transparency prompt only limits how third parties use advertising identifiers; it does not stop Bahut from processing the telemetry necessary to operate, secure, and monetise Chappie.

7. User Content and Licence

You retain ownership of the text, audio, and other content you submit ("User Content"). By using the Services you grant Bahut a worldwide, non-exclusive, royalty-free licence to host, process, adapt, and display User Content for the purpose of operating, improving, and securing the Services. Where allowed by law you also permit us to use anonymised or aggregated data to train and evaluate our AI models. We will not sell your personal data. The licence ends when your account is deleted, except for anonymised data or copies we must retain to comply with law, resolve disputes, or enforce these Terms.

You are responsible for ensuring you have the rights to share any User Content you submit and that you do not infringe third-party rights.

8. Educational Content and AI Outputs

Chappie provides language-learning exercises, simulated conversations, and AI-generated guidance for educational purposes only. We do not guarantee that any output is error-free or suitable for professional or exam preparation. You should review AI suggestions with your own judgement before relying on them.

9. Privacy

Our processing of personal data is described in the Privacy Policy. By using the Services you acknowledge that we collect and use your data as described there, including transfers to our service providers. Please review the policy to understand your rights and how to exercise them.

10. Communications

We may send you transactional messages (for example, account notices, security alerts, or service updates). You can opt into or out of marketing messages in-app or by using the unsubscribe link in any email. Push notification preferences can be managed from your device settings.

11. Suspension and Termination

We may suspend or terminate your access at any time with notice if you breach these Terms, create risk or legal exposure for us, or if we discontinue the Services. You may stop using the Services at any time. Upon termination, sections that by their nature should survive (including payment obligations, licences, disclaimers, and limitations of liability) will continue in effect.

12. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that language outcomes will meet your expectations.

13. Limitation of Liability

To the fullest extent permitted by law, Bahut, its directors, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Services. Our aggregate liability for any claim is limited to the greater of (a) £50 or (b) the amount you paid to use the Services in the six months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud or death/personal injury caused by negligence).

14. Indemnity

You agree to indemnify and hold harmless Bahut and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, breach of these Terms, or violation of any law or third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. We do not currently offer our Services in the EU or EEA. All disputes shall be resolved exclusively in the courts of England and Wales, and you agree to that venue. Nothing in this section limits your right to pursue alternative dispute resolution under UK law where applicable.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify you through the app, email, or by posting an updated notice. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
